Marketplace Booking Terms

The agreement governing the Neluxsis marketplace, its platform role, reservation records, fees, payments, and responsibility boundaries.

1. Platform role

Neluxsis LLC, doing business as Neluxsis, provides technology that may connect travelers with independently operated accommodations. Unless a listing expressly states otherwise, Neluxsis does not own, operate, manage, inspect, or control an accommodation.

The owner or authorized operator is responsible for providing the accommodation and honoring a confirmed reservation. Neluxsis does not guarantee safety, quality, legality, availability, owner performance, traveler satisfaction, or the accuracy of every owner or traveler statement.

2. Reservation formation

A reservation is not confirmed until the booking gate approves the unit, dates, guests, pricing, compliance profile, required agreements, and trusted payment status. A browser confirmation, pending bank debit, or temporary inventory hold is not a confirmed reservation.

The reservation record will preserve the exact unit, dates, guests, displayed charges, applicable fee rates, tax snapshot, cancellation-policy version, property-rules version, and agreement versions accepted at booking.

3. Prices and fees

Before payment, Neluxsis will display the total mandatory price and separately identify taxes as permitted. The traveler service fee is 7% of the applicable rental subtotal. Mandatory owner charges, such as cleaning or other required property fees, must be shown before payment.

Neluxsis charges the owner no platform fee, no commission, no listing fee, and no subscription. This is not an introductory rate and does not expire. Payment-processing costs, taxes, refunds, and other applicable adjustments are separate and are not Neluxsis fees. The fee applicable to a booking is stored when that booking is created and is not changed retroactively.

4. Independent responsibilities

Owners remain responsible for authority to rent, accurate content, rates, availability, licenses, permits, HOA rules, insurance, safety, occupancy limits, emergency contacts, property rules, taxes not expressly handled by Neluxsis, and lawful photo or content rights.

Travelers remain responsible for accurate account and party information, payment, age and occupancy requirements, conduct, property rules, damage caused by their party, check-in and check-out obligations, and good-faith use of payment disputes.

5. Other controlling documents

A booking will also be governed by the Traveler Booking Agreement, the accepted cancellation policy, the property rules, Payment and Payout Terms, the Neluxsis Terms and Privacy Policy, and any mandatory payment-provider terms presented during checkout.

If documents conflict, the more specific booking document controls for the subject it expressly addresses, except that mandatory law always controls. Merchant status, chargebacks, tax remittance, reserves, and exceptional refunds are handled under the current Payment and Payout Terms, cancellation policy, payment-provider arrangement, and applicable law.

6. Electronic records and changes

Checkout must require affirmative acceptance and provide a durable copy of the booking confirmation, controlling agreements, property rules, and price snapshot. Silence, continued occupancy alone, or a preselected checkbox will not be treated as acceptance of a new booking agreement.

A later revision to a Neluxsis document applies prospectively from its stated effective date. It does not replace the versions stored with an existing booking unless the affected parties affirmatively accept a lawful amendment or applicable law requires the change.

7. Platform integrity and account actions

Users may not misuse the service, provide false identity or booking information, interfere with security, scrape protected content, evade disclosed marketplace fees, move a Neluxsis-sourced booking off platform to avoid obligations, or use another person’s account without authority.

Neluxsis may investigate, restrict, suspend, or terminate booking access when reasonably necessary for fraud prevention, safety, legal compliance, payment risk, repeated owner cancellation, material rule violations, or protection of users. Any action affecting an existing booking remains subject to the booking documents, payment status, and applicable law.

8. Third-party services and excluded provisions

Payment processing, identity verification, maps, communications, and other third-party services may be governed by their own terms. A link, listing, or integration does not by itself constitute Neluxsis endorsement of an accommodation or third party.

These terms do not adopt a limitation of liability, indemnification, governing-law, venue, mandatory-arbitration, jury-waiver, or class-action-waiver provision unless it appears in a later published version presented for acceptance. No provision is adopted merely because another marketplace uses it.
